CUSTOMS WAREHOUSE

              The Customs warehousing procedure enables importers and exporters to keep their goods temporarily (for 2 months) in customs warehouses without the payment of duties and taxes and without the application of economic restrictions and prohibitions.

    Goods can be imported for storage in a warehouse and re-exported in the same state. But traders can use this procedure to improve the packaging and marketable qualities of the goods and to prepare them for shipment. Such operations include: repacking, sorting and grading, breaking bulk, grouping of packages.

    This customs procedure gives importers and exporters a number of advantages. For example, they can import goods in bulk, at discounted prices and place the goods in the customs warehouse. Then the trader can re-negotiate sales abroad on more favorable terms and re-export the similar quantities of goods at higher prices, making foreign exchange gains.

    In some cases exporters are permitted to use warehousing facilities to combine domestic goods with identical imported goods to satisfy a single export order.

    The warehousing procedure can be used to assist home manufacturers in producing goods for export. There are traders who specialize in wholesale trade and act as agents for manufacturers. They consolidate small import orders from different companies and import consignments in bulk on the most favorable terms. After that they offer their goods to home producers at lower prices than the prices for small importations.

    Besides, warehousing procedure helps exporters to obtain refunds of import duties and taxes before the actual exportation of the goods, thereby facilitating their cash flow.

    Customs warehouses may be either public or private. ”Public warehouse” is available for use by any person and “Private warehouse” is reserved by a warehouse-keeper who must be authorized by the Customs.

    The warehousing procedure enables the authorities: to assist manufacturers in producing goods for export and thus develop a country’s external trade as well as to earn foreign currency for the services rendered at the warehouses and provide employment opportunities.

Drug Smuggler Arrested


Customs officials at a Sheremetyevo-2 airport have arrested a Columbian man accused of smuggling a record amount of cocaine inside his stomach. The man was transporting over a kilo of cocaine to Hong Kong via Russia. The Colombian approached a customs officer and asked him for medical help. The officer suspected drug smuggling and the man was taken to a hospital where an X-ray showed that his stomach was packed with special containers filled with cocaine. It turned out that the man was trying to transport 1148 grams of the drug in 86 containers. If sold,  it could bring him over one million dollars. Usually, drug smugglers do not swallow more than 600 grams.

       This way of transporting is considered to be especially dangerous as it can kill the smuggler if the covers of containers are destroyed in the stomach.

       If found guilty, the man might face up to 20 years in a Russian prison. He claims, however that he was forced to smuggle drugs by the Columbian mafia.

CUSTOMS VIOLATIONS

    Criminals use different types of violations of customs regulations. The most common of them are aimed at tax evasion as well as evasion from licensing and certification from the authorities.  

    (1) False declaration – is an infringement, when goods are not declared or are declared under the wrong commodity description. When imported goods are subject to a high rate of taxation, various schemes are used by criminals, for example:

- some categories of goods may be declared as their parts because the rates of tariffs for parts are lower than for ready-made goods;

- some goods may be declared under the wrong description when goods with similar functions and similar classification code attract lower rates of duty;

- one type of commodity may be claimed for another when due to complex chemical composition, it cannot be defined during visual examination and only laboratory tests can reveal falsification (wood, metal, chemicals, etc.).

    To prevent such violations customs officers check the supporting cargo documents, screen the goods, make tests at customs laboratories.

    (2) Pseudo re-export. According to the Customs Code, re-export is a customs procedure which implies that goods are imported into the customs territory of the Russian Federation to be re-exported not later than 6 months since the date when cargo declaration was accepted for inward customs clearance. The merchandise is exempt from import duties and other economic regulatory measures. In case of violation, foreign goods are imported free from duty and sold on the customs territory of the country but the documents are cleared under re-export procedure without actual export of goods across the frontiers.

    To protect the revenue and to guarantee the payment Customs authorities require that, placing his goods under re-export procedure, the trader must transfer to the deposit account of the Customs the amount of duty to be paid when importing goods for Home Use. The whole sum remains there till the goods are cleared and factually exported from the customs territory. Then the trader can get a refund.

    Other customs violations include: undervaluation, counterfeiting, clearance of goods with forged supporting documents, violation of currency regulations during purchase-and-sale transactions, etc.

    Shots are fired almost every night on the Nemunas River, creating a natural frontier separating the European Union from Russia. It is the front line of Lithuania’s fight to stem a multi-million-dollar trade in cigarettes smuggled in from the western Russian exclave of Kaliningrad.

    Armed with helicopters, automatic weapons and night-vision scopes, Lithuanian border guards try to find an invisible army of smugglers who use high speed boats to push their wares across. Counterfeit cigarettes are typically floated by swimmers wearing black diving suits and dragging caravans of waterproof crates. Their accomplices are waiting on the opposite banks with trucks to take the load to secret warehouses in small villages. From there, they are distributed nationwide.

    Border guards have detained dozens of smugglers who are willing to risk their lives. To the Lithuanian and Russian gangs, it’s worth the risk because huge money is at stake. Lithuania loses millions of euros every year because according to the survey every third smoked cigarette came into the country illegally.

    The smugglers are wily and work hand-in-glove to avoid capture. Border guards cannot build a wall in the middle of the river but with more time, technology and money they can seize more contraband.

U.S. Hit by Russian Pirate Sales


       Sales of pirated films, software and books in Russia cost U.S. copyright holders billions of dollars. Only China surpassed Russia in piracy.

       Increasing the penalty for counterfeiters and using special labels to make pirated merchandise easier to recognize are among the suggestions put forward by the lawmakers.

       Deputy Prosecutor General called for a crackdown on manufacturers and retailers of counterfeit merchandise, as on those who provide floor spaces, equipment or other support for pirates.

       Unauthorized copies of the latest Hollywood hits as well as pirated business software are easy to find throughout the country and it results in the large losses for copyright holders.

       Counterfeit goods account for 35 to 90 percent of turnover in certain market segments, but the most troubling are food and medicine.

CUSTOMS MISSION

Text 

    Russia has had a Customs Service in some form for about 1000 years and Customs business has always been considered important and prestigious.

    The Customs mission is actually threefold: to collect and protect revenue; to enforce customs and other laws; and to interdict the illegal flow of narcotics and other contraband.

    Collection and protection of revenue is the responsibility with which the Customs started. Most of that fiscal activity takes place at different ports of entry where commercial cargo arrives from abroad. The Customs performs inspections to ensure that the merchandise fits the description and quantity claimed on the documents. Subsequent paper processing determines the proper classification and duty assessment. Ultimately, the Customs actually makes the collection of the revenue.

    The Customs had to establish the legal foundation to facilitate legitimate trade and travel, to encourage business, to safeguard the quality of life and public health. The first Russian Customs Statute was handed down in 1667. It was the first attempt to arrange customs regimes. Nowadays, besides its own laws and intricate rates of duty, the Customs enforces a number of laws of other federal agencies  such as: Culture Ministry, Health Ministry, Agriculture Ministry, Tax Service, Immigration Service, etc.

    The Customs is responsible for traditional border-related law enforcement responsibilities, and one of the primary missions nowadays is anti-terrorism, that is why Customs officers screen all people, vehicles and goods entering the country. To act efficiently, the Customs has to upgrade the skills of inspectional staff; set up special enforcement teams; develop intelligence gathering techniques; solidify cooperation with other law enforcement agencies; carry out controlled deliveries and international operations.

    Today the Russian Federation has a modern, multi-functioning Customs Service which provides the bulk of the federal budget, is the expert authority in the movement of goods across national boundaries, vigorously carries out its enforcement activities and enables this country to be an equal member of the world community.

CBP Officers Find Marijuana in Fuel Tank


US CBP officers seized 66,5 kg of marijuana. CBP officers made the seizure after a 1988 Chevrolet pickup truck arrived at the port of entry from Mexico. During the search, CBP officers used a fiber optic scope to peer into fuel tank and noticed anomalies in its appearance. CBP drug sniffing dog “Dollar”  searched the vehicle and alerted his handler to the presence of narcotics. CBP officers continued their examination by removing fuel tank. They dismantled the tank and discovered 5 sealed metal boxes inside. The boxes were opened and revealed 66,5 kg of marijuana. The driver, a 55-year-old US resident was arrested and now he faces federal prosecution on drug charges.
